Session 9ААС under the claim of Fund of Princes for the term less right of use of the Moscow Kremlin has taken place. The appeal court has upheld the decision of court of the first instance. As a reconciliatory step Fund of Princes has suggested authorities of the Russian Federation by an anniversary of the 1150-anniversary of the Russian statehood in 2012 in common to create Cultural–historical fund Kremlin of Russia. Today session 9 Arbitration appeal courts under the claim of Fund of Princes to authorities of Russia about claim the term less right of use the Moscow Kremlin has taken place. After consideration of several petitions, the court has passed to consideration of an affair in essence. Fund of Princes within the framework of process has transferred Respondents the project of the Agreement of lawsuit on which by 2012 it is supposed to create Cultural–historical fund Kremlin of Russia. Within the framework of the agreement, the Claimant refuses claims and the claim, and initiates before the parties of an affair, the third parties and other interested persons, namely the President of the Russian Federation, the Government of the Russian Federation, Russian Orthodox Church and others, joint creation with participation of the claimant, Cultural–historical fund Kremlin of Russia. In new Fund it is supposed to transfer objects Kremlin of Russia, with preservation to them to a state ownership. Thus taking into account that submitting the given Claim, the Claimant put before itself cultural–educational problems extremely in attraction of attention of the country leaders, the public and mass-media to a problem of the current condition of majority Kremlin of Russia. Therefore with creation of Cultural–historical fund Kremlin of Russia, the claimant will count a problem of the Claim executed and realized. Respondents, it enters into whose competence, or the persons authorized by them, till October 31, 2011 with participation of the Claimant as the initiator and the interested person, should create Cultural–historical fund Kremlin of Russia and conclude with the created fund the Contract of gratuitous using, the Rent-security contract, either other contract or the document, under the form and legal essence not contradicting to the current legislation on the objects coordinated by the parties. The offer of Fund of Princes fully complies with spirit and the letter of the Decree № 267 from 03.03.2011 of the President of the Russian Federation D.A. Medvedev About celebrating the 1150-anniversary of origin of the Russian statehood in connection with an anniversary of calling Rurik on reigning Novgorodian in 862.
